고대 로마 시대에도 권력 남용을 막기 위한 ‘트리뷴’ 제도가 있었다는 사실!
‘탄핵’은 민주주의 사회에서 권력 남용을 견제하는 중요한 장치입니다.
대한민국 헌법 제65조에 따르면 대통령, 국무총리, 국무위원 등이 직무를 수행하면서 헌법이나 법률을 위반할 경우 국회에서 탄핵 소추를 할 수 있습니다.
탄핵심판은 대통령을 포함한 고위 공직자가 헌법이나 법률을 위반했을 때, 그 책임을 묻는 제도입니다.
국민의 대표인 국회가 탄핵을 소추하고, 헌법재판소가 이를 심판하여 공직자를 파면할 수 있습니다.
탄핵 소추는 국회의원 재적 과반수의 발의로 시작되며,
대통령 탄핵의 경우 국회의원 3분의 2 이상의 찬성이 필요합니다.
이후 헌법재판소가 최종적으로 탄핵을 결정합니다.
헌법재판소는 피소추인의 행위가 헌법과 법률을 심각하게 위반했는지를 판단하며,
헌법재판관 6인 이상의 찬성으로 탄핵이 결정되면 해당 공직자는 즉시 직에서 물러나게 됩니다.
역사적으로 탄핵은 민주주의 국가에서 권력의 남용을 방지하는 중요한 수단이었습니다.
예를 들어,
1998년 미국의 빌 클린턴 대통령과 2021년 도널드 트럼프 대통령도 탄핵 소추를 당했지만,
최종적으로 파면되지는 않았습니다.
대한민국에서도 2004년 노무현 대통령이 탄핵 소추를 당했으나 기각되었고,
2017년 박근혜 대통령의 탄핵은 인용되어 파면되었습니다.
탄핵제도는 민주주의 사회의 핵심 가치를 지키는 중요한 제도입니다.

According to Article 65 of the Constitution of South Korea, the National Assembly can initiate an impeachment process if the President, Prime Minister, or other high-ranking officials violate the Constitution or laws while performing their duties.
An impeachment trial is a system that holds high-ranking officials, including the President, accountable for violating the Constitution or laws.
The National Assembly, representing the people, initiates the impeachment, and the Constitutional Court reviews and decides whether to remove the official from office.
The impeachment process begins with a motion supported by a majority of the National Assembly members.
For a presidential impeachment, at least two-thirds of the Assembly must vote in favor.
The Constitutional Court then makes the final decision.
If at least six of the nine justices agree that the accused has seriously violated the Constitution or laws, the official is immediately removed from office.
Historically, impeachment has been an essential tool to prevent the abuse of power in democratic nations.
For example,
U.S. Presidents Bill Clinton (1998) and Donald Trump (2021) were impeached but were not removed from office.
In South Korea, President Roh Moo-hyun was impeached in 2004, but the motion was dismissed.
However, in 2017, President Park Geun-hye was impeached and officially removed from office.
